TERMS OF USE FOR THE WEBSITE AND DIGITAL SERVICES
Website Operator: 9288-4030 Québec Inc. | Last Updated: November 4, 2026
These Terms of Use (the “Terms”) apply to the website https://jacksaloon.com/ and to the digital features offered on it or accessible through it (collectively, the “Services”). The website is operated by 9288-4030 Québec inc., doing business under the name JACK SALOON (hereinafter “Jack Saloon,” “we,” or “our”). The restaurants listed under the brand may be operated by legally separate entities, including franchisees.
1. Acceptance and Scope
By accessing or using the Services, you acknowledge that you have read these Terms. Where the law requires express consent or specific acceptance for a transaction, such consent or acceptance will be requested separately.
These Terms govern your use of the site and do not supersede any specific terms applicable to a reservation, ticket purchase, promotional offer, loyalty program, or contract entered into with a business. In the event of any conflict, the specific terms and conditions applicable to the transaction in question shall prevail for that transaction, subject to mandatory laws.
Content and offers relating to alcoholic beverages are intended for individuals of legal drinking age and remain subject to the rules in effect in the relevant jurisdiction.
2. Description of Services
In particular, the website features the Jack Saloon restaurants, their menus, events, shows, and activities, as well as ways to contact them, request corporate or private reservations, and access reservation or loyalty programs when available.
Features may vary from one establishment to another. The presence of a restaurant, offer, or activity on the site does not guarantee its availability on a specific date. Hours of operation, availability, menus, prices, shows, and other information are subject to change, within the limits provided by law.
3. Intellectual Property
The website, its layout, and its content—including text, photographs, videos, drawings, graphics, software, trade names, logos, and distinctive marks—are protected by applicable intellectual property laws and are the property of Jack Saloon or their respective owners.
Unless prior written authorization has been granted or an exception is provided for by law, you may not reproduce, modify, distribute, commercially exploit, or use the protected elements of the site. No rights to a trademark or other intellectual property are transferred to you as a result of your use of the Services.
It is also prohibited to use the JACK SALOON name or distinctive marks in a manner that could imply an affiliation, sponsorship, or authorization that does not exist.
4. Permitted Uses
You may view the Services and use their publicly available features for personal, lawful, and intended purposes, including viewing a menu, learning about a show, contacting the team, or accessing a booking platform.
Companies wishing to use the content of this site for professional, commercial, or promotional purposes must first obtain the appropriate authorization, unless such use is expressly permitted by law.
5. Prohibited Conduct
Without limiting the prohibitions set forth in applicable laws, you may not: (a) infringe on the rights of others; (b) impersonate another person or knowingly provide fraudulent information; (c) attempt to gain unauthorized access to an account, server, or data; (d) circumvent a security measure or disrupt the Services; (e) transmit malicious code; (f) use bots or mass scraping techniques that interfere with the operation of the site or the rights of its owners; (g) collect other users’ personal information without a legal basis; or (h) use the site for any unlawful activity. Jack Saloon may take reasonable measures necessary to stop any misuse, including limiting access to a feature, subject to users’ rights and applicable laws.
6. Menus, Prices, Events, and Promotions
The descriptions, photographs, menus, prices, and availability shown are provided for informational purposes only and may vary by restaurant, time of year, and circumstances. Taxes, fees, and specific terms and conditions are disclosed when required by law.
Events and performances may be modified, postponed, or canceled for operational reasons or for reasons beyond our control. The terms and conditions regarding tickets, deposits, cancellations, and refunds, if applicable, must be specified at the time of purchase and comply with applicable mandatory provisions.
Communications regarding alcoholic beverages remain subject to applicable laws and regulations. Nothing on this site should be construed as authorizing any prohibited sale, consumption, or promotion.
7. Reservations and Third-Party Providers
Certain links on the site lead to booking platforms operated by third parties, including providers such as Libro or Now Book It, depending on the establishment. You may therefore be subject to the privacy policies and terms and conditions of these providers.
A reservation is confirmed only in accordance with the procedures and terms provided by the restaurant or the relevant platform. Any requirements regarding deposits, late arrivals, no-shows, groups, or cancellations, if applicable, must be made known to you before you are bound by the reservation.
Jack Saloon does not control all third-party systems. However, the exclusions set forth herein do not limit the liabilities that the law may impose on Jack Saloon or the establishment in question.
8. Privacy and Commercial Communications
The processing of personal information collected by the Services is described in Jack Saloon’s Privacy Policy, which must specify, among other things, the purposes of collection, the categories of information, the service providers involved, the rights of individuals, and the means of contacting the privacy officer.
Making a reservation, requesting a quote for an event, or browsing the website does not automatically constitute consent to receive promotional messages. Newsletters, promotional offers, and other commercial emails are sent in accordance with applicable consent and opt-out rules.
A customer’s information is not automatically accessible to all restaurants under the brand. Any sharing of information among companies, the franchisor, franchisees, and suppliers must comply with applicable laws and be limited to the stated purposes.
9. External Links
The website may contain links to websites, social media platforms, reservation platforms, loyalty programs, or other independent services. These resources are governed by their own policies and terms and conditions.
The presence of a link does not necessarily constitute an endorsement of all content accessible through the third party. You are advised to review the third party’s contractual and privacy documents before providing it with any information or entering into a transaction.
10. Availability and No Absolute Warranty
Jack Saloon makes reasonable efforts to keep the information on the site up to date and to ensure its proper functioning. However, errors, interruptions, incompatibilities, or unavailability may occur.
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without any warranty of uninterrupted or error-free operation. Nothing herein shall exclude any warranty or right that cannot be excluded by law, including those granted to consumers.
11. Limitation of Liability
To the extent permitted by applicable law, Jack Saloon assumes no liability for damages arising exclusively from an external failure, unauthorized use of the Services, or an event beyond its reasonable control, where no fault or legal obligation can be attributed to it.
These Terms and Conditions do not exclude or limit any liability that cannot be legally excluded or limited, in particular due to consumer protection laws, laws regarding bodily injury or emotional distress, or any mandatory provision of Quebec law.
Each establishment or service provider remains liable for its own commitments and activities in accordance with the facts and applicable laws.
12. User Liability
You are responsible for the accuracy of the information you voluntarily provide and for your use of the Services. You agree not to commit any wrongdoing or infringe upon the rights of Jack Saloon, any establishment, or any third party.
A claim for damages arising from wrongful conduct is governed by the applicable general rules of liability; these Terms do not create any automatic or disproportionate compensation.
13. Governing Law, Amendments, and General Provisions
These Terms are governed by the laws of Quebec and the applicable federal laws of Canada. The competent courts shall be determined in accordance with the applicable rules of jurisdiction, including those protecting consumers. No provision shall have the effect of depriving a consumer of a forum to which they are legally entitled.
Jack Saloon may modify these Terms to reflect changes in the Services, practices, or legal framework. The updated version will be published along with its date. A modification may not retroactively revoke an acquired right or alter an existing contract when the law requires notice, consent, or another formality.
If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in effect to the extent that they are enforceable. Failure to exercise a right immediately does not necessarily constitute a waiver of that right.
